Terms of service

What you are booking, how to book it, how payment works, what happens if something goes wrong and, above all, what you may do with the photographs you receive.

1. What you are booking

You are booking a photographic reportage: coverage of one combination, that is, one rider with one specific horse, during the agreed classes at a specific equestrian show, and the subsequent delivery of a selection of edited photographs in a private gallery.

What you pay for is the coverage and the editing work, not a number of files. This is not a photo shop: there is no sale of individual images, no basket and no per-photo licences.

If the same rider competes on several horses, each combination is a separate commission, although overall terms can be agreed.

2. Who the parties are

On one side, Clara Taboada García, tax number 47289110Y, address Calle Pablo Gargallo 61, 28035 Madrid, trading as Clara T Media. On the other, the person requesting the reportage, who must be of legal age and have capacity to contract.

If the rider photographed is a minor, the contracting party is their parent or guardian, who also declares that they have sufficient authority to authorise the reportage.

3. How booking works

There are four steps, and none of them involves paying on the website:

Clara publishes in the diary the shows she will be attending, with the days covered and the places available. A show that is not listed is not ruled out: you can ask.
You send a request stating the show, the days, the rider, the horse and the classes entered. You can write it in your own words: there is no need to find your combination in a dropdown.
A request is not a booking. It is an enquiry and it does not hold a place on its own. Clara reviews it and replies by email.
The booking exists once Clara expressly accepts it. From that moment there is a contract and the place is yours.

Clara may decline a request if the diary for that show is full, if she ends up not attending, if the classes requested clash with others already committed, or if the request does not fit the service. In that case you are told as soon as possible and nothing is charged.

4. Price and payment

The price of the reportage is agreed directly with Clara before the show, based on the days, the number of classes and the travel involved. Where the diary shows an indicative price, that is exactly what it is: a guide, not a firm offer.

No payment is taken on this website. There is no payment gateway, no basket, and card details are never requested or stored at any point. Payment is made outside the application, usually by bank transfer or Bizum, and Clara records it by hand when it arrives.

A deposit may be agreed to hold the place, and it is deducted from the final price. The invoice is issued by Clara, with the applicable VAT itemised; it is drawn up on her behalf and in her name by her accountant. Its number is recorded against your booking.

All agreed amounts are in euros and include the applicable VAT. The invoice itemises it. The indicative prices shown in the diary include VAT too.

If anyone asks you for card details saying it is to pay for a Clara T Media reportage, it is not Clara. This site never takes payment.

5. Cancellations and changes

If you cancel, counting always from the first day of the booked show:

More than seven calendar days in advance: no charge, and any deposit is refunded in full.
Between seven days and forty-eight hours before: the deposit is retained, because by then the place can no longer be reallocated.
Less than forty-eight hours before, or if the combination does not turn up: the full agreed amount is invoiced, because the travel and the day are already committed.
Changing horse, day or class within the same show does not count as a cancellation, provided it fits that day's schedule and you give notice as soon as you know.

This reportage is tied to the specific date of a show, so the fourteen-day right of withdrawal for distance contracts does not apply (article 103.l of the consolidated Spanish Consumer Protection Act). The cancellation terms in this section apply instead.

6. If Clara is the one who cancels

If Clara cannot attend because of illness, an accident, equipment failure or any other cause, she tells you as soon as she knows and refunds everything you had paid in full, with no retention of any kind. If the cancellation is due to something attributable to Clara, on top of the refund she covers the expenses you had incurred for that reportage, as long as you can evidence them and can no longer avoid them. If it is due to force majeure, the full refund is the only consequence. Nothing here limits the rights the law gives you as a consumer when a contract is breached.

If the show is suspended, postponed or cancelled by the organiser, because of the state of the arena or because of the weather, the booking is moved to another show in the diary at no cost, or the deposit is refunded in full, at your choice.

If for reasons outside Clara's control the combination does not end up competing, coverage of another class at the same show is offered; if that is not possible, the deposit is refunded.

7. How the reportage is carried out

Clara photographs the booked combination in the agreed classes, looking for the jump, the expression and the moment. The result is a selection edited by her, with her judgement and her colour treatment.

What is guaranteed is coverage of the agreed classes and an edited selection of professional quality. What is not guaranteed is an exact number of photographs, a particular framing or a specific artistic outcome: this is creative work over a sport that happens once.

Some circumstances can limit the result and are outside Clara's control: a fall or a withdrawal, a change in the starting order, a covered arena with poor light, an interruption by the organiser, or restricted access to the working area. If the combination does not jump, the previous section applies.

8. Delivery time and format

Deadlines run in calendar days from the last day of the show covered:

A sample preselection within forty-eight hours at most, so you have something to post while it is still news.
The full edited gallery within ten calendar days at most.
The gallery is private. It is delivered by email with access through a one-time code or, if you prefer, through a secret link that you must not share publicly.
Each photograph downloads at original resolution and without a watermark, and there is also a single compressed archive with the whole gallery.
The gallery stays available for twelve months from publication. It is worth downloading and keeping your own copy: after that it is archived.

If a deadline is going to be missed for good reason, you are told before it expires and a new date is proposed.

9. What you may do with the photos: the licence

Paying for the reportage gives you a non-exclusive, worldwide, perpetual, royalty-free and non-transferable licence of use, included in the price and with no need to ask permission each time, for the following:

Personal and private use: viewing, storing, printing, framing, making an album or giving copies to your family.
Posting them on the social media profiles of the rider, their family and the horse's owner, including stories, posts and short videos, always with a visible «© Clara T Media» credit or a mention of her profile in the post.
Sending them to the club, the trainer or the horse's owner for their personal use, with the same credit.
Using them in a private advertisement by the owner to sell the horse, with a visible credit. That is included; advertising for a yard, a stud or a professional is not.
Minor cropping to fit a social network's format, provided the signature is not removed and the meaning of the image is not altered.

Authorship and intellectual property are and will remain Clara's. This licence is a permission to use, not an assignment of exploitation rights and not a purchase of the photographs.

10. What the licence does not cover

Anything not listed above requires a separate written agreement with its own scope, duration and price. In particular, you may not:

Resell the photographs, license them, assign them or upload them to stock image libraries.
Use them in advertising, catalogues, campaigns, sponsorships or commercial communications of any brand, feed company, equipment manufacturer, yard, stud, club or industry professional.
Use them in the media, sports press or publications that exploit them commercially, without a prior agreement.
Remove, crop or cover the signature or credit, or publish them without attributing authorship, which is a moral right that cannot be waived (article 14 of the Spanish Intellectual Property Act).
Materially alter the image, composite it with others, apply filters that distort the work, or use the photograph in a context that harms the reputation of the author or of the rider.
Register them as your own, claim authorship or upload them to services that require you to declare that you are the author.
Publicly share the private gallery link or the full compressed archive.

11. Artificial intelligence and data mining

Using the photographs, in whole or in part, to train, fine-tune or evaluate artificial intelligence systems is expressly prohibited, as is uploading them to services whose terms claim that right.

The author expressly reserves her rights against text and data mining under article 4.3 of Directive (EU) 2019/790 and Spanish Royal Decree-Law 24/2021 implementing it. This reservation covers all content delivered and published, and is also expressed in machine-readable form on the site itself.

12. What Clara may do with the photos

Clara retains the exploitation rights as the author, but undertakes the following towards you:

Publishing a photograph in the portfolio, on the public site or on her social media requires the prior consent of the rider who appears in it, given on a separate screen, with versioned wording and revocable at any time. The image right is theirs, not that of whoever pays for the reportage: if you are not that person, you may only authorise publication when you have their authorisation or their representation, and by ticking the box you declare that you have it. Without that consent, the photographs are used only to deliver them to you.

If the rider is a minor, that consent is given by their parent or guardian, and without it the gallery cannot be made public or indexable by search engines.

Withdrawing consent does not affect delivery or the rest of the service, and costs nothing. Posts already made are taken down within a reasonable time of being told; on third-party social networks, so far as it is technically possible.

13. Image rights and third parties

By booking you declare that you are able to authorise the reportage of the rider you name and, if you later tick the image rights box, the publication of their photographs too, either because it is you, or because you have their authorisation or legal representation.

Clara photographs the person who booked her. If a third party appears incidentally in a photograph, that person may ask for it to be taken down by writing to claratmedia@gmail.com, and the request is honoured.

Access to the arena and to the working areas depends on each show's organiser. If the show requires accreditation, a photographer's fee or prior authorisation, that is arranged beforehand and any cost is expressly agreed.

14. Your obligations

Very little is asked of you, but it is needed:

Give accurate details, above all the horse's name, the rider's name and the classes: that is what makes it possible to find your photographs among thousands.
Give notice as soon as possible of any change of class, horse or time.
Look after access to your gallery and do not circulate the private link.
Respect the licence of use and the authorship credit.
Pay the agreed amount within the agreed time.

15. Liability

Clara's liability for any breach is limited to the amount actually paid for the reportage concerned, except in cases of wilful misconduct or gross negligence, except for personal injury, which cannot be limited, and except for the expenses Clara covers when a cancellation is attributable to her.

No liability is accepted where the reportage cannot be carried out for reasons of force majeure, including suspension of the show, closure of the venue, adverse weather or the organiser refusing access.

Backups of the original files are kept, but you should download and keep your own copy of the gallery: no storage system is infallible and Clara's retention period is the one stated in the privacy policy.

Nothing in these terms limits the rights that consumer legislation grants consumers on a mandatory basis.

16. Personal data

The processing of the data you provide when booking, and of the photographs, is described in the privacy policy, which forms part of these terms.

17. Complaints, governing law and jurisdiction

Any complaint can be sent to claratmedia@gmail.com and is answered within one month at most.

These terms are governed by Spanish law. If the client is a consumer, the courts of their domicile have jurisdiction. In all other cases the parties submit to the courts of the owner's domicile.

Consumers may also turn to their municipal consumer information office or to the consumer arbitration board of their autonomous region.

18. Changes and applicable version

These terms may be updated. Every version carries a number and a date.

Each booking is governed by the version in force when the request was sent, even if it changes afterwards. If a change affects a booking already accepted, it is communicated and only applied with your agreement.
